Draft legislation (The Pubs Code etc. Regulations 2016) regulating practices and procedures to be followed by large pub-owning businesses (those owning 500 or more tied pubs in England and Wales), such as Admiral, Punch, Greene King, Enterprise and Marston’s was recently laid before parliament.
The Department for Business, Innovation and Skills has confirmed that this legislation has not yet been enforced but are hoping that it will be before the end of the summer recess in July.
As part of the new regulations pub owners will be required to keep a Schedule of Condition updated for every property, which is something they didn’t have to do before. Any time there is any refurbishment or upgrade to a property or change in the lease they will need to update the Schedule of Condition.
Pub Owners will be drawing on the expertise of those qualified to carry out Schedule of Conditions in preparing for this new legislation. One of the challenges that surveyors will face is the efficient management and reporting of repeat inspections with subsequent updates being added to the original report.
